Artificial Intelligence: Is it Ready for use by the Dispute Board Community?

This interactive workshop aims to explore the potential of Artificial Intelligence (AI) in transforming the dispute resolution process. Participants will engage with a model project and a realistic dispute scenario, designed to demonstrate the practical application of AI tools in real-time. Throughout the session, attendees will collaborate to create project-related documentation, which will serve as input data for testing various AI capabilities.

The workshop will deal with the matter of confidentiality and will delve into how AI can detect early warning signs of disputes, predict areas of potential conflict, and assist in preparing for resolution strategies. By analyzing data generated during the session, participants will gain hands-on experience with how AI models can be primed and tailored to support dispute resolution.

Additionally, the session will culminate in demonstrations showcasing the outcomes of applying AI to the prepared data, highlighting its role in improving efficiency, accuracy, and decision-making in dispute resolution. This engaging, hands-on workshop is ideal for professionals eager to further their understanding and to evaluate the readiness of AI tools for use in the resolution of complex project disputes.

The Ultimate Guide to how a Dispute Board Deals with Quantum

Disputes that are referred to a Dispute Board for a decision or recommendation invariably

involve time and money claims. In relation to such disputes, this workshop focuses on the
issues and principles that need to be considered by a Dispute Board when dealing with
evaluation of quantum. It is based on actual case studies, and incorporates practical issues
that have arisen from various parties’ submissions to the Dispute Board.

This workshop is an essential guide to best practice techniques and procedures, and
provides practical insights on how the Dispute Board may address some of the potential
difficulties in reaching decisions on quantum. Topics covered include:

  • On what basis should the DB make its decision?
  • What if there are insufficient particulars to substantiate quantum
  • Impact of differing jurisdictions
  • Extension of time
  • Prolongation
  • Disruption
  • Head office overheads
  • Financing charges
  • Future losses
  • Reimbursement of parties’ costs
  • Global claims

This workshop will be of particular benefit to people who present or defend claims to Dispute Boards, and for practitioners who are active on DBs or interested in serving on DBs. The workshop is designed to promote group interaction and discussion, and there will be ample opportunity for questions and interactive discussions.

Guidance for Dispute Board Obligations in the SEA/SH Prevention Mechanism

The World Bank has published special versions of its Standard Procurement Documents for use in relation to projects identified as being at high risk of SEA/SH incidents. These impose strict obligations upon the Contractor and its subcontractors, but also on the Employer and the Engineer. The Standard Procurement Documents also include a mechanism by which the Contractor and its subcontractors who fail to fulfil their obligations can be disqualified from other projects financed by the World Bank, for a period of two years.

This training will explain the obligations, the mechanism and the very specific role of the DAAB in helping to prevent SEA/SH incidents. It will be provided by the two experienced DAAB practitioners who assisted the World Bank in developing the mechanism.

The DRBF held an information webinar on this topic with Enzo de Laurentiis, who was Chief Procurement Officer at The World Bank at the time of the recording. View the recording at the DRBF's YouTube channel.
